Creator Agreement

This Creator Agreement governs participation as a creator on the Happy Fans platform operated by Globold Group Inc.
By registering as a creator on happyfans.app you agree to be bound by this Agreement in addition to the Platform’s Terms of Service and Privacy Policy.
If you do not agree to this Agreement, you may not use the Platform as a creator.

1. Creator Eligibility

To register as a creator on Happy Fans, you must:
• be at least 18 years old
• have the legal capacity to enter into binding contracts
• comply with all applicable laws and regulations
• complete identity verification if required
Happy Fans may require additional verification to comply with payment processor, anti-fraud, or regulatory requirements.

2. Creator Content

Creators may upload and publish content including but not limited to:
• photos
• videos
• live streams
• digital media
• posts and messages
Creators are solely responsible for the content they upload to the Platform.
Creators represent and warrant that:
• they own the content or have all rights necessary to publish it
• all individuals appearing in the content are 18 years or older
• consent has been obtained from any identifiable person appearing in the content
Creators may not upload content that violates intellectual property rights or applicable laws.

3. Intellectual Property Rights

Creators retain ownership of their content.
By uploading content to the Platform, creators grant Happy Fans a worldwide, non-exclusive, royalty-free license to:
• host
• store
• reproduce
• distribute
• display
such content solely for the purpose of operating, promoting, and providing the Platform services.
4. Creator Monetization
Creators may earn revenue through features such as:
• subscriptions
• tips
• pay-per-view content
• digital experiences
• merchandise sales
Happy Fans acts as a technology platform facilitating transactions between creators and fans.
5. Platform Commission
Happy Fans charges a 20% platform commission on creator earnings.
The commission is automatically deducted from transactions before creator payouts are processed.
The remaining balance after commission constitutes the creator’s net earnings.

6. Payment Processing Fees

Transactions on the Platform may be processed through third-party payment providers.
Payment processors may charge additional fees for:
• payment acceptance
• card processing
• currency conversion
• payout transfers
These fees may be deducted from transaction amounts or creator balances depending on the payment provider.
Happy Fans does not control third-party processing fees.

7. Payouts to Creators

Creators may withdraw available balances through supported payout methods offered on the Platform.
Payout options may include:
• bank transfers
• digital wallets
• card payouts
• instant payout rails (where supported)
Where available, instant payouts may allow creators to receive earnings immediately.
However, payout speed depends on:
• payment processor availability
• banking infrastructure
• geographic region
In markets where instant payout infrastructure is not available, payouts may take several business days.

8. Global Availability of Services

Happy Fans operates globally, but payment features may vary by country.
Certain payout methods may not be available in all jurisdictions due to:
• banking infrastructure
• payment processor support
• regulatory restrictions
Creators are responsible for ensuring that use of the Platform complies with local laws in their jurisdiction.

9. Taxes

Creators are solely responsible for:
• reporting income earned on the Platform
• paying applicable taxes in their jurisdiction
Happy Fans does not provide tax advice and may provide transaction reports for creator reference.
Where required by law, Happy Fans or payment providers may collect tax-related information.

10. Refunds and Chargebacks

Fans may request refunds or initiate chargebacks through their payment provider.
If a transaction is reversed due to:
• refunds
• disputes
• fraud investigations
the corresponding amount may be deducted from the creator’s balance.
Happy Fans reserves the right to temporarily hold funds where fraud or abuse is suspected.

11. Account Suspension or Termination

Happy Fans may suspend or terminate creator accounts that:
• violate this Agreement
• violate the Terms of Service
• upload illegal or prohibited content
• engage in fraudulent activity
Upon termination, creators may lose access to the Platform.
Outstanding balances may be subject to review before payout.

12. Limitation of Liability

Happy Fans provides the Platform “as is” and “as available.”
To the maximum extent permitted by law, Happy Fans shall not be liable for:
• loss of earnings
• platform interruptions
• payment processor errors
• indirect or consequential damages
13. Changes to This Agreement
Happy Fans may update this Creator Agreement from time to time.
Updates will be posted on the Platform with a revised effective date.
Continued use of the Platform after updates constitutes acceptance of the revised Agreement.
14. Governing Law
This Agreement shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
